Terms and conditions for orders from Blood Button
These terms apply to every order placed through bloodbutton.com, and the German version is the binding one.
1. Scope of these terms and who can order
These terms apply to all contracts between Livy Health GmbH, Kolonnenstraße 8, 10827 Berlin (“we”), trading as Blood Button, and its customers.
Customers can be businesses within the meaning of § 14 BGB or consumers within the meaning of § 13 BGB, and some clauses below apply to only one of these groups.
We deliver only to addresses in the European Union, and private buyers must be at least 18 years old.
2. How a contract is concluded through the online shop
The products shown in the shop are an invitation to order and not a binding offer.
By completing the checkout you make a binding offer to buy the selected products, and the contract is concluded when we confirm the order by email.
We store the contract text, and you receive the order details and these terms by email after the order.
3. Prices, shipping costs and VAT
Prices for businesses are net prices plus statutory VAT, and prices for consumers include statutory VAT.
Shipping costs are shown before the order is placed and are charged per parcel.
Businesses in another EU member state that provide a valid VAT identification number are invoiced without German VAT under the reverse charge procedure.
4. Payment methods and when payment is due
Payment is processed by Stripe Payments Europe, Ltd., and the available payment methods are shown at checkout.
Payment is due when the order is placed, and for bulk orders by email we deliver against advance payment by bank transfer.
5. Delivery, delivery times and transfer of risk
Orders placed by 14:00 Berlin time on a working day are handed to the carrier the same working day, as long as the products are in stock.
The delivery times shown are the carrier’s usual times and are not guaranteed unless we expressly confirm a delivery date.
For businesses, the risk passes to the customer when we hand the goods to the carrier, while for consumers it passes on delivery.
6. Retention of title until full payment
The goods remain our property until the purchase price has been paid in full.
7. Warranty for defects and inspection duties
The statutory warranty rights for defects apply to every order.
Businesses must inspect the goods without undue delay after delivery and report visible defects in writing within five working days, as § 377 of the German Commercial Code requires between merchants.
For businesses, the limitation period for warranty claims is twelve months from delivery, except for claims for damages.
8. Liability for damages under these terms
We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the Product Liability Act.
For slight negligence we are liable only for breaches of essential contractual obligations, limited to the damage that was foreseeable and typical for this kind of contract.
9. Intended use of the medical devices we sell
Tasso+ is a medical device, and customers must use it only as described in the manufacturer’s instructions for use.
Customers who supply the devices to third parties, for example in their own test kits, are responsible for their own obligations under the Medical Device Regulation.
10. Right of withdrawal for consumers
Consumers have a right of withdrawal, which our withdrawal policy explains in full.
11. Applicable law, place of jurisdiction and language
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, but consumers keep the protection of the mandatory law of the country where they live.
For contracts with merchants, legal entities under public law and special funds under public law, the place of jurisdiction is Berlin.
Contracts can be concluded in German or English, and the German version of these terms prevails.
